    You might be aware of this... There is an Oats Company called Quaker Oats.

    Has idsoftware taken part in a legal battle with Quaker Oats? Who has the right to use the "Quake" name/title? Did Quaker Oats accuse idsoftware of "stealing their name"? Did Quaker Oats try to sue idsoftware? Or maybe it's the other way around... Maybe idsoftware tried to sue Quaker Oats... I don't know. Seriously, I don't have any problems with Quaker Oats... Matter of fact, I consume some of their food products. I brought this issue up because of curiosity.

    trademarks used to apply to only a single field. there's no reason you can't have eg: a restraunt called Rage, and a computer game called Rage, for instance. completely different fields.
    now that pretty much every company is some sort of tech company, things get much more messy.
    Yes, they're similar, but they're not identical, and they're different fields. this is pretty much a non-issue.
    Additionally, trademarks generally require companies to sue in order to retain the trademark. The fact that they've both been around for so long now means that neither *can* sue, so long as neither branches out into the other's field.

    Simply put, a name is just a name. Its only illegal when there is deliberate or probable confusion between them.

      i bought a box of Quake,

      all the cereal was gone though
      but i found a toy surprise CD inside!

        Well, there is also the fact that one is called Quake and the other is called Quaker Oats, which isn't the same thing at all.

        Quaker: a member of the Religious Society of Friends, a Christian movement founded by George Fox circa 1650 and devoted to peaceful principles. Central to the Quakers' belief is the doctrine of the “Inner Light,” or sense of Christ's direct working in the soul. This has led them to reject both formal ministry and all set forms of worship.

        oat: a cereal plant cultivated chiefly in cool climates and widely used for animal feed as well as human consumption.

        Quake: An 18 year old video game

        It's as different as Coca-Cola and Pensicola
